This Privacy Policy describes the Personal Information AmeriGas Propane, L.P., its affiliates and subsidiaries (collectively “AmeriGas”, “we”, “our”, or “us”) collects, how we use this information, with whom we share it, and the choices you have in connection with these activities. This Privacy Policy applies to the AmeriGas website, AmeriGas.com, and any sub-domains, including but not limited to MymeriGas.com, AmeriGasInfo.com (collectively, the “Website”), and any products or services that we offer or that we have linked to this Privacy Policy (collectively, our “Services”).
Users of AmeriGas online services agree to our Website Terms of Use. This Privacy Policy is incorporated into our Website Terms of Use, which can be found at https://www.amerigas.com/website-terms-of-use.
Please review the Website Terms of Use carefully, as it contains restrictions on your legal rights in any dispute with AmeriGas to the extent a dispute involves or is related to our online Services, Website Terms of Use, or this Privacy Policy. By using our online Services, you represent and warrant that you are over eighteen (18) years of age, the legal age to form a binding contract with AmeriGas, and meet all of the eligibility requirements in the Website Terms of Use.
I. WHAT PERSONAL INFORMATION IS COLLECTED AND PROCESSED
Through your use of our Website and Services, we collect “Personal Information”, which is any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly. Through your use of our Website and Services, we collect Personal Information as outlined below.
A. Information We Collect and How and Why We Use It
When you visit our Website, become a customer of AmeriGas, or contact us via telephone or other means, we collect your Personal Information and process it in the following ways:
- When you request a quote. When you request a quote for our Services, we may collect from you your personal identifiers (name, street address, email address, mobile telephone number, and other telephone number), your professional identifiers (company name, title company email address, company street address, and company telephone number) and any additional information regarding your propane use which you provide to us. We use this information to determine the price of your propane, to determine if we deliver to your location, to communicate with you regarding your quote and our Services, to market our Services to you (which you may opt out of according to the YOUR INFORMATION CHOICES section of this Privacy Policy), and of other aspects of our Services. We use third-party map providers to determine if the address provided is within our geographical service area. These providers could include Google Maps or Apple Maps. Any information collected by the third-party map providers will be governed by the respective third-party map provider’s terms of service.
- When you become an AmeriGas customer. When you become an AmeriGas customer, we collect customer information from you which includes your personal identifiers (name, street address, email address, mobile telephone number, and other telephone number), and your professional identifiers (company name, company email address, and company street address). If you decide to apply for credit terms, we collect from you your sensitive Personal Information (i.e. Social Security Number), and, if you decide to pay your bill online, we collect additional sensitive Personal Information including your financial information (credit card number, debit card number, bank account number, and routing number) required to process your payment. You also have the option to pay your bill online via a PayPal account. We use the collected information to create and manage your account, verify your identify, provide you with our Services, collect payment for our Services, provide refunds (if necessary), send you marketing and service-related emails, text messages and other communications, and communicate with you regarding your use of our Services. Please refer to the YOUR INFORMATION CHOICES section of this Privacy Policy for information about managing these communications.
- When we receive information about you. If information is provided on any of our online forms (including, but not limited to, Residential Referral or School Days forms) on our Website, depending on the form, or we receive information about you from a third party, we may collect your personal identifiers (name, street address, email address, mobile telephone number, and other telephone number[s]), business identifiers (AmeriGas-generated school ID, institution registration, institution name, address, contact name, and contact email address). We may also collect from you the provider’s (if the provider is not you) personal identifiers and business identifiers. We may use the information provided for the purposes disclosed on the form which was completed and to otherwise provide you with our Services. For more information, please refer to the specific form which is being completed.
- Use your account. In addition to the Personal Information you provide to us when you become a customer, we collect from you your account purchase history (account holder period, propane usage, delivery preferences, any subscription or delivery services in which you are enrolled, and corresponding Services specifications) over the course of your relationship with AmeriGas as our customer. We also collect your tank’s information (e.g., tank serial number, tank ownership, storage object capacity, tank description, above/underground, tank orientation, and maximum fill percentage). We use this information to provide you with AmeriGas Services, including but not limited to the ability to schedule your propane delivery, view the status of your account, or to send you notifications regarding the Services you use.
- Use a tank monitor. In addition to the information mentioned in the “Use Your Account” section, if you have a tank monitor on your propane tank, we collect your tank telemetry, which includes information related to your tank’s propane levels (e.g. the amount of propane in the tank), and may include, but is not limited to, your location information (GPS location of tank monitor). We use this information to monitor the amount of propane in the tank, send you alerts when you need a refill of propane, and more efficiently provide you Services.
- When you find any of our locations. When you search for any of our locations (propane tank exchange, propane cylinder refill locations, and local office locations) on our Website we collect from you your geolocation information (zip code). We use this information to provide you with a list of locations near you for you to use our Services. If you click the hyperlink for “Directions”, you will leave our Website and be directed to a third-party site, Google Maps. Once you leave our Website, any information collection will be subject to Google’s Maps Terms of Service.
- When you visit one of our physical locations. If you visit one of our physical locations, we will collect from you your personal identifiers (name, street address, email address, mobile telephone number, and other telephone number[s]) and through our CCTV footage we may automatically collect your visual information (video recording of you). We use this information to answer your questions, address any issues you may have regarding our Services, and maintain the safety and security of our employees and offices.
- When you contact us. In addition to any information specified above, when you communicate with us (for example by email or phone), we may collect your personal identifiers (name, street address, email address, mobile telephone number, and other telephone number[s]), and any other information related to the nature of your call. We use this information to communicate with you regarding your inquiry, appropriately provide you with the Services, respond to your inquiries, and answer any questions you have.
- When you use a self-serve vending machine. When you make a purchase from certain self-serve propane cylinder vending machines, we collect from you your financial information (credit card number or debit card number) and geolocation information (zip code). We use this information to process your payment.
- When you engage with our promotions and surveys. When you engage with AmeriGas promotions, including but not limited to entering a Sweepstakes or Contest, or participate in a referral program or survey, we may collect from you your personal identifiers (name, street, address, email address, mobile telephone number, and other telephone number[s]), promotion and survey information (birthday, and, if required by law, Social Security number). We use this information to implement the promotion in compliance with applicable laws and if applicable, implement the survey and aggregate learnings, and for marketing or advertising purposes. We only use personal identifiers for marketing purposes.
- Interact with us on our social networking websites. When you interact with us on social networking websites, such as Facebook (Meta), Instagram, X (formerly Twitter), and LinkedIn (each a “Fan Page” and collectively “Fan Pages”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing. - Fan Pages. When interacting with our Fan Pages, we collect, from you your Fan Page personal identifiers (first and last name and profile picture) as well as any information that you provide when interacting with our Fan Pages (e.g. commenting, sharing, and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. Because our Fan Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments, or liking or sharing posts, any Personal Information that you post or provide when registering can be viewed by others or used by other users as they see fit.
- Community management. With the help of a third party, we collect, from you, your contact (including "likes", shares, and messages) interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. We use this information to create advertisements that match our Fan Page and to disseminate them via Facebook based on demographic data.
- Facebook Fan Page insights. When you visit our Facebook Fan Page, Facebook records your IP address and other information about your usage behavior on our Facebook Fan Page. Facebook collects, through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Facebook app through your mobile device (e.g. smartphone or tablet). Facebook uses this information to create statistical evaluations of the use of the Fan Page. We receive this information from Facebook in the form of aggregated data and anonymous statistics regarding things like age, gender, city/country, device, inquiries from fans about other Facebook Fan Pages, region and language settings of the users, proportion of men and women, the number of people reached, clicks on posts, "likes” and reactions, comments and shared content, and total video views. We do not collect or process any other Personal Information in connection with the page insights. We do not retain this information independently. It has been contractually agreed with Facebook that Facebook is responsible for providing you with information about the processing for Fan Page insights.
- Information processed solely by Facebook. We do not know how Facebook uses Personal Information for its own purposes, how long the Personal Information is stored on Facebook or whether Facebook data is shared with third parties. If you are currently logged in to Facebook as a user, Facebook automatically collects, through trackers on your device, your Facebook ID or a link between the Facebook ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Facebook app through your mobile device (e.g. smartphone or tablet). This enables Facebook to understand that you have visited our Facebook Fan Page along with other Facebook pages that you have clicked on, whether you clicked on Facebook buttons integrated into websites that partner with Facebook, and other online interactions that report user data to Facebook. Based on this data, content or advertising tailored to you can be offered. B. Information Collected Automatically via Cookies and Similar Technologies
In addition to the Personal Information you provide directly to us, we also collect information from you automatically as you use our Website and Services via “cookies.” This includes the following internet or other electronic network activity information:
- Usage information. We use strictly necessary (essential), functional, performance (analytics), targeting (advertising), and social media cookies to collect information about your interaction with our Website and Services, such as what you access, what you click on, the frequency of access, and how much time you spend on the Website and Services.
- Device information. We use strictly necessary (essential), functional, performance (analytics), targeting (advertising), and social media cookies to collect certain information about the device you use to access the Website and Services, such as hardware model, operating system, and device preferences.
- Location information. We use strictly necessary (essential), functional, performance (analytics), targeting (advertising), and social media cookies to collect information about your location, which may be determined through your IP address.
We use usage, device, and location information to: (i) track activities within the Website and Services; (ii) enhance user experience; (iii) conduct analytics to improve the Website and Services; (iv) prevent fraudulent use of the Website and Services; and (v) diagnose and repair Website and Services errors, and, in cases of abuse, track and mitigate the abuse.
We retain and use information collected via third-party cookies or other trackers only on an anonymized and aggregated basis. Some of these cookies and other trackers are placed by third-party cookie providers, who will retain Personal Information subject to their own practices.
In general, to disable cookies and limit the collection and use of Personal Information through cookies, you can set your browser to refuse cookies or indicate when a cookie is being sent. II. HOW WE SHARE YOUR PERSONAL INFORMATION
A. General Sharing
AmeriGas shares Personal Information in the following instances:
- Within AmeriGas. We may share your Personal Information within AmeriGas departments, with our parent company, UGI Corporation, and with affiliated entities for the legitimate business purposes of efficiently and effectively providing the Services. We use role-based access control to protect your Personal Information.
- With service providers. We share Personal Information with service providers that assist us in providing the Website and Services. These service providers include our financial vendors (including billing and invoicing providers, credit check providers, and debt collectors), telecommunications vendors, email provider, IT provider(s), installation and maintenance providers, call center providers, customer service providers, risk management providers, distribution providers, fraud prevention providers, contract management providers, claims providers, consultants, printing providers, and marketing providers.
- In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share Personal Information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. Customers will be notified if or when AmeriGas is no longer their Services provider. We would also share Personal Information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
- For legal purposes. We will share your Personal Information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.
B. Sharing for a Business Purpose
In the preceding twelve (12) months, or in the future, AmeriGas has disclosed, or may disclose, the following Personal Information for a business purpose with the following categories of third parties:
- We have disclosed your internet or other electronic network information collected by cookies to our IT support provider(s) to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair Website and platform errors.
- We have disclosed your internet or other electronic network information collected by cookies to our IT support provider(s) to update, improve, and maintain the Website and platform.
- We have disclosed your Personal Information with service providers that perform services on our behalf. These service providers include our financial providers, telecommunications providers, email provider, IT provider(s), call center provider, credit check provider, customer service providers, providers involved in the processing of payments and refunds, contract management provider, marketing providers, risk management providers, distribution and telemetry providers, fraud prevention providers, claims providers, billing and invoicing providers, printing providers, consultants, and service subcontractors.
C. Sale of Personal Information
In the preceding twelve (12) months, AmeriGas has shared your internet or other electronic network activity information collected via cookies and other tracking technologies with our data analytics providers and ad networks as described in the “Information Collected Automatically via Cookies and Similar Technologies” section of this Privacy Policy. D. Collection, Use, or Sale of Personal Information for the Purpose of Training Large Language Models
AmeriGas has not, to date, collected, used or sold any of your Personal Information for the purpose of Training Large Language Models. If this were to change, we would update this Privacy Policy and would provide notice of the same as required by applicable laws.
III. YOUR INFORMATION CHOICES
You have the following choices with respect to your Personal Information:
- Correct or view your Personal Information. You may use your MyAmeriGas account to correct or view certain Personal Information you have provided to us. Further details about how to access and correct your information related to our other Services and portals (such as Cynch) can be found in the individual privacy policies for those Services.
- Location settings. You can prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device.
- Opt out of other cookies. To set your cookie preferences or opt out of the sale/sharing of your information via cookies, please see our cookie preference center. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. To find out what cookies have been set on your computer or device, and how to reject and delete the cookies, please visit https://www.aboutcookies.org/. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s website and/or mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our Website may not function properly. If you choose to opt out, we will place an opt-out cookie on your device. The opt-out cookie is browser-specific and device-specific and only lasts until cookies are cleared from your browser or device. The opt out cookie will not work for essential cookies. If the opt out cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. By clicking any of the opt out links below, you will be directed to the respective third-party website where your computer will be scanned to determine who maintains cookies on you. - Marketing correspondence. You may opt out of marketing emails, texts messages, and/or automated/prerecorded calls from us. Please note that it may take up to ten (10) business days for us to process your opt out request. In addition, even if you unsubscribe from marketing communications, we will continue to send you notifications necessary to the Services. In addition to contacting us using the methods described in the “CONTACT US” section below, you may opt out of marketing correspondence using the following methods:
- Emails. You may opt out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email or by logging into your MyAmeriGas account.
- Text messaging. You may opt out of receiving text messages by replying “STOP” to any text message received, contacting AmeriGas at 1-800-263-7442, or updating your communication preferences in your MyAmeriGas account.
- Automated/pre-recorded calls. You may opt out of receiving automated and pre-recorded calls by logging into your MyAmeriGas account or by calling AmeriGas at 1-800-263-7442.
- Please note that it may take up to ten (10) business days for us to process your opt out request. In addition, even if you opt out of marketing communications, we will continue to send you notifications necessary to the Services.
IV. DO NOT TRACK
Do Not Track (“DNT”) is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable DNT by visiting the Preferences or Settings page of your web browser. AmeriGas does not respond to DNT signals and handles all user information consistent with its Terms of Use and this Privacy Policy.
V. SECURITY OF YOUR PERSONAL INFORMATION
AmeriGas employs data collection, storage and processing practices, and security measures designed to protect Personal Information against unauthorized access, alteration, disclosure, or destruction. When appropriate, we use firewalls and limits on who can access databases that store Personal Information.
Please keep in mind that it is not possible to achieve a perfect state of data security. Although we maintain reasonable administrative, physical, and electronic security measures designed to protect your Personal Information from unauthorized access, we cannot ensure absolute security of any information you transmit to us or guarantee that this information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your Personal Information. To the extent the law of your jurisdiction allows for notification of a breach via e-mail or conspicuous posting on the Services, you agree to accept notice in that form. The Services may contain links to other websites or services that we do not own or operate. We are not responsible for the practices employed by any websites or services linked to or from the Services, including the information or content contained within them. Your browsing and interaction on any third-party website or service, including those that have a link on our Services, are subject to that third party’s own rules and policies, not ours.
VII. AGE RESTRICTION
The Services are not intended for individuals under the age of sixteen (16). If we learn that we have collected or received Personal Information from an individual under the age of sixteen (16), we will delete that Personal Information. If you believe we might have Personal Information from or about an individual under the age of sixteen (16), please contact us using one of the other methods in the Contact Us section below. VIII. CHANGES TO THIS PRIVACY POLICY
We may amend this Privacy Policy in our sole discretion at any time. If we do, we will post the changes to this page and will indicate the date the changes go into effect. We encourage you to review our Privacy Policy regularly to stay informed. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on the Website, if required by applicable law.
IX. ADDITIONAL PRIVACY RIGHTS BASED ON LOCATION
If you are a resident of California, Connecticut, Maryland, Montana, Nebraska, New Hampshire, Texas and Virginia, you may have specific rights regarding your Personal Information, subject to certain exceptions:
Right to Access/Know and Right to Data Portability (All States): You can request information about what Personal Information we have collected, used, disclosed, shared and/or sold about you. This right can be exercised twice per 12-month period. You can request your data in a portable, readily usable format.
Right to Request Deletion (All States): You can request deletion of your Personal Information, subject to certain exceptions, including where retention is required for legal compliance (federal/state laws, DOT/FMCSA requirements, etc.).
Right to Correct (All States): You can correct inaccurate Personal Information we maintain about you.
Right to Opt-Out of Sale/Sharing (All States): You can opt out of the sale or sharing of your Personal Information. We currently only sell or share Personal Data via third-party cookies.
Right to Non-Discrimination (California, Connecticut, Montana, Nevada, Texas and Virginia): You have the right to not receive discriminatory treatment for exercising your privacy rights.
Right to Limit Sensitive Data Use (California): You can limit use of sensitive Personal Information (SSN, financial data) to what's necessary for providing the Services or certain other permissible purposes. AmeriGas does not use your sensitive Personal Information beyond what is disclosed in this Privacy Policy.
Right to Opt-Out of Profiling/Targeted Advertising (All States): You can opt out of data processing for targeted advertising or profiling purposes.
Right to Appeal (Virginia): You can appeal any of our decisions in response to your privacy requests.
